Consumer Rights

Applicability

This Consumer Rights Policy applies where:

• The Client is classified as a “consumer” under applicable law
• Goods or services are not acquired for resale or business use above statutory thresholds
• Mandatory consumer protection legislation applies

For business-to-business transactions, additional contractual terms may apply to the extent permitted by law.

Consumer Guarantees

Where applicable, consumers are entitled to guarantees including that:

• Products are of acceptable quality
• Products match their description
• Products are fit for purpose disclosed by the consumer
• Services are provided with due care and skill
• Services are supplied within a reasonable time

These guarantees cannot be excluded by contract.

Remedies Under Consumer Law

If a product or service fails to meet consumer guarantees, the consumer may be entitled to:

• Repair of goods
• Replacement of goods
• Refund (in certain cases)
• Re-supply of services

The appropriate remedy depends on whether the failure is classified as major or minor under applicable law.

Limitation of Remedies

To the extent permitted by law, MachinesDock may elect the appropriate remedy, which may include:

• Replacement of equivalent products
• Repair of goods
• Refund of purchase price
• Re-performance of services

Third-Party Products

You acknowledge that MachinesDock supplies third-party products. Where a defect arises:

• MachinesDock acts as a procurement intermediary and does not assume manufacturer warranty obligations
• Primary responsibility lies with the manufacturer or vendor
• MachinesDock may assist in facilitating warranty or claims processes

Exclusions

Consumer rights under ACL may be limited where goods or services are acquired:

• For resupply or commercial resale
• In a purely business-to-business transaction (B2B)
• Where the issue arises from misuse, modification, or improper installation
• Where failure results from third-party software, systems, or integrations

No Additional Warranty

Except as required by law:

• MachinesDock does not provide additional warranties
• All manufacturer warranties apply independently
• No implied guarantees beyond statutory rights are offered
